Accident on I-79 in West Virginia injures 6

An accident on Interstate 79 in West Virginia on Jan. 16 left five passenger vehicle occupants and a Marion County Deputy injured. After undergoing surgery to treat a badly injured leg, the deputy was listed in stable condition. The five vehicle occupants have all been released by a Morgantown hospital. A 17-year-old driver has been charged in connection with the crash, which took place on the southbound lanes of I-79 near East Fairmont at approximately 8:45 p.m.

The deputy was dispatched to the scene when the Marion County sheriff's office received reports of a vehicle fire at approximately 8:15 p.m. Reports indicate that he was struck when a Mitsubishi sedan driven by the teen struck the rear of a Jeep SUV with a 62-year-old man behind the wheel. Police say that he was injured while placing warning flares in the center lane. The Jeep also contained a 31-year-old woman and children aged 15 and 2.

Responding emergency services personnel found the injured deputy lying in a ditch approximately 40 feet away from the road. According to reports, the Jeep was struck after it moved from the center to the left lane to avoid the deputy. The teen was charged for failing to control his vehicle and driving without proof of insurance. Both of the charges are misdemeanor traffic violations.

When presented with facts like these, personal injury attorneys with car accident lawsuit experience may study police reports closely. Drivers who strike the rear-ends of other vehicles are generally considered to have acted negligently; however, there are some exceptions to this rule. Establishing negligence may be challenging if some sort of mechanical failure occurred or another vehicle made an abrupt and unexpected maneuver.
