Motorcyclist dies during surgery after crash in West Virginia

Seeing motorcycles on the roadways stretching across the state of West Virginia is not rare. Motorcyclists can be seen traveling on major roads, city streets and residential areas throughout most of the year. While most drivers on the roadway are aware that they share the roads with other vehicles, these small vehicles often go unnoticed. This is because motorcycles are difficult to see if they are in the blind spot of a driver. Furthermore, if a driver fails to check these areas or does not adequately check traffic before making a maneuver, he or she could easily collide with one of these small vehicles.

The West Virginia State Police were recently dispatched to the scene of a fatal motorcycle crash in Harrison County. According to reports, the motorcycle accident occurred on Sardis Road around 12:30 p.m. Authorities believe that the driver of an automobile crossed the centerline, causing a Collision with a motorcyclist.

Emergency crews responded to the crash. The 41-year-old motorcyclist was transported to the hospital, where he later died undergoing surgery. The 33-year-old driver of the automobile has not been cited at this time, but it was reported that the driver could still face charges. Investigation is still ongoing, and once completed, the driver could face criminal penalties and civil liability.

When a negligent driver causes a fatal crash, he or she could have a wrongful death claim filed against them by the loved ones of the deceased. This could help family members recover compensation, which could be used to cover financial burdens associated with the accident. The monetary award could be used to alleviate the bills related to medical expenses, funeral costs, lost wages and damages.

A fatal or serious accident not only affects those involved, but their family members, as well. It is not only important to establish cause, but to understand how the facts and details of the accident could essentially help them. A cause of action could be available to surviving family members and a legal professional could help them determine this and assist them through the process.
