West Virginia bike struck by driver with fogged windows

Riding a bicycle in West Virginia is not without its dangers. Due to their smaller profile, cyclists are often not as visible to motorists as another automobile. This is especially true when the motorist is distracted or not watching for cyclists or pedestrians. It is important for drivers to reduce speeds when approaching crosswalks and avoid distracting activities such as talking or texting on their cellphones.

Authorities in Dunbar recently responded to a bicycle accident in which a man was injured. The accident occurred around 7:40 a.m. Emergency crews were dispatched to an intersection on 22nd Street. According to reports, a 1996 Chevy Camaro driven by an 18-year-old man struck the 55-year-old cyclist.

The young driver claimed that his windows were fogged up, and as a result he was not able to see the man on his bike. The cyclist was transported to a local hospital where he received treatment for the injuries he suffered. Fortunately, his injuries were not serious and he was released. The young driver was cited for reckless driving following the accident.

One who is injured in a bicycle accident caused by a negligent motorist has the right to sue the motorist for personal injuries. The victim can recover monetary damages to cover not only the out-of-pocket expenses associated with the incident such as medical bills, but also pain and suffering, scarring and disfigurement. Negligent drivers create serious dangers for other drivers, pedestrians and bicyclists. A person injured by a negligent driver should understand their legal options and rights.
