Unsecured truckload injures, kills in West Virginia accident


It is rather difficult to travel on the roads in West Virginia without encountering a semi-truck or tractor-trailer. These massive vehicles are able to carry large loads and often transport them a long distance. Whether they are making a short or long distance shipment, truck drivers have numerous responsibilities. In addition to driving safely and avoiding fatigue, truck drivers need to ensure the safety of the vehicle itself. That means ensuring the truck is operating properly, the tires are in good condition and the load on the truck is secured. Failure to do so could result in a serious truck accident.

Authorities in West Virginia were recently dispatched to an incident described as a freak accident. A fatal truck accident occurred on Interstate 64 in Huntington around 5:30 p.m. The crash involved a tractor-trailer and a motorcycle, and reports indicate that the accident was initiated by an unsecured truckload.

The motorcyclist was traveling with a passenger, and when they turned onto the highway near West 17th Street, a large steel beam fell off of the tractor-trailer and fell onto the motorcycle. Though emergency crews arrived at the scene, the female passenger and wife to the motorcycle driver died. Her husband was in critical condition and was transported to the hospital for medical treatment.

Investigation is still ongoing and the truck driver was cited for having an unsecured load. The driver could face additional traffic and criminal charges following investigation. Furthermore, the driver could also endure civil claims. A wrongful death suit could potentially be filed for the death of the passenger and a personal injury claim could be filed by the injured motorcyclist. These claims could result in compensation to cover the expenses and damages caused by the tuck accident.

When a fatal truck accident occurs, those involved or affected by the collision should be aware of their legal remedies. The loss of a loved one can be tremendously difficult to cope with, and when the negligence of another causes their death, they are often able to bring civil actions against the party at fault.
