Driver charged with fatal crash that kills man and his daughter

For some residents in West Virginia, it would be very difficult to get through daily life without an automobile. But although cars are extremely useful and practical, motorized vehicles can lead to some serious and even fatal incidents when a driver is not properly paying attention or not abiding by a certain standard of care. This can happen when a driver texts or is under the influence. A negligent driver and his or her actions could hurt a number of people on the road, including their friends and loved ones.

A woman was recently charged following a fatal accident that killed two people, including a 7-week-old girl, on a West Virginia Highway. The 28-year-old driver was arrested for two counts for driving under the influence and one count of child neglect resulting in death.

According to reports, the Pennsylvania woman had methamphetamine and a controlled substance in her system at the time of the accident on U.S. Route 250. The car crash also resulted in the death of the 29-year-old driver of the other car and his young daughter.

In addition to facing criminal charges, the driver could also endure civil liabilities. The loved ones of the deceased could file a wrongful death claim. This would allow them to recover a monetary award to help with financial burdens associated with the fatal accident. Compensation could cover expenses such as funeral bills, lost wages, lost of companionship, damages and pain and suffering.

The loss of a loved one is a difficult to process, and it could take time to cope with a major loss. In these instances, it is helpful to speak with an attorney who may be able to help them with the situation and determine whether there is a cause of action. A successful claim against a negligent driver could help the victim or the victim's family on the road toward recovery.
